TERMS OF SERVICE
1. Acceptance of Terms
By accessing or using Arcade ("the Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.
Your use of the Platform constitutes acceptance of these Terms and our Privacy Policy, which is incorporated by reference. We may update these Terms at any time, and continued use after changes constitutes acceptance of the revised Terms.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to use the Platform. By using Arcade, you represent and warrant that:
- You meet the minimum age requirement in your jurisdiction.
- You are not located in, or a citizen or resident of, any Restricted Jurisdiction (see Section 11).
- You are not subject to any sanctions or restrictions imposed by any government authority.
- Your use of the Platform complies with all applicable laws and regulations in your jurisdiction.
3. Description of Service
Arcade is a token launchpad on Arc Chain (Circle's EVM-compatible Layer 1 blockchain). The Platform provides:
- Token creation through smart contracts with automatic liquidity pool creation on DyorSwap.
- Trading of tokens via DyorSwap (Uniswap V2 compatible) liquidity pools.
- Settlement of all transactions in USDC, Arc Chain's native gas token.
- Standard ERC-20 token contracts with LP pairs tradeable on any compatible DEX or aggregator.
The Platform operates on Arc Chain mainnet (Chain ID: 5042). All transactions involve real USDC with real-world monetary value. Tokens are launched with liquidity pairs on DyorSwap, a decentralized exchange on Arc Chain.
4. User Responsibilities
As a user of the Platform, you are responsible for:
- Maintaining the security of your wallet and private keys. We never have access to your private keys and cannot recover lost funds.
- Ensuring sufficient USDC balance for gas fees and transactions.
- Understanding the risks associated with cryptocurrency trading, bonding curves, and smart contracts.
- Conducting your own research before creating or trading any token on the Platform.
- Complying with all applicable local, state, national, and international laws.
- All content you upload, including token names, symbols, descriptions, and images.
5. Prohibited Activities
You agree not to use the Platform for:
- Market manipulation: wash trading, spoofing, pump-and-dump schemes, or any coordinated activity intended to artificially influence token prices.
- Fraud: creating tokens that impersonate other projects, individuals, or organizations; making false claims about token utility or backing.
- Illegal content: creating tokens with names, symbols, or images that promote violence, hate speech, child exploitation, or any illegal activity.
- Intellectual property violation: using trademarks, copyrighted material, or other protected intellectual property without authorization.
- Money laundering: using the Platform to launder proceeds of criminal activity or to finance terrorism.
- Sanctions evasion: using the Platform to circumvent any economic or trade sanctions.
- Automated abuse: deploying bots, scripts, or automated systems that degrade the Platform's performance or exploit the bonding curve mechanics in a manner inconsistent with normal trading.
- Circumvention: attempting to bypass any security measures, rate limits, or access controls.
We reserve the right to remove tokens, restrict access, or take other action against users who violate these prohibitions, to the extent technically possible given the decentralized nature of the Platform.
6. Fees
The Platform charges the following fees on every buy and sell transaction:
- Platform fee: 2% of the initial liquidity amount, collected at token creation by the Arcade treasury.
- Trading fees: Standard DyorSwap 0.3% LP fee on every swap, distributed to liquidity providers.
The platform fee is applied automatically by the smart contract at token creation and cannot be waived, refunded, or reversed. Arcade does not charge additional fees on trades. Users are responsible for blockchain gas fees charged by Arc Chain. We may adjust fee rates in the future with reasonable notice.
7. Intellectual Property
The Arcade brand, logo, user interface, and smart contract code are the intellectual property of the Platform operators. You may not copy, modify, distribute, or create derivative works of any Platform materials without written permission.
By uploading content (token images, descriptions, or other media), you grant the Platform a non-exclusive, royalty-free, worldwide license to display and distribute that content in connection with the Platform's operation. You retain ownership of your original content and represent that you have the right to upload it.
8. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
- Nothing on the Platform constitutes financial, investment, legal, or tax advice.
- Tokens created on Arcade have no inherent, intrinsic, or guaranteed value.
- We do not endorse, verify, or audit any token created on the Platform.
- We make no guarantees regarding the availability, uptime, or functionality of the Platform or Arc Chain.
- Past performance of any token is not indicative of future results.
- We do not guarantee that any token will graduate or that a liquid secondary market will exist.
9. Limitation of Liability
To the maximum extent permitted by applicable law, the Platform operators, affiliates, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of funds, tokens, or USDC resulting from trades, smart contract interactions, or wallet compromises.
- Loss of profits or anticipated gains from token trading.
- Damages resulting from unauthorized access to your wallet or account.
- Damages resulting from smart contract bugs, exploits, or vulnerabilities.
- Damages resulting from Arc Chain network outages, congestion, or failures.
- Damages resulting from third-party actions, including other users' token creation or trading activities.
Our total aggregate liability for any claims arising from or related to the Platform shall not exceed the amount of Platform fees you have paid in the 12 months preceding the claim.
10. Risk Warnings
Cryptocurrency trading involves substantial risk of loss. By using the Platform, you acknowledge and accept the following risks:
- Price volatility: Token prices on bonding curves can change rapidly. You may lose some or all of your investment.
- Smart contract risk: The Platform relies on smart contracts deployed on Arc Chain. While these contracts have been developed with care, they may contain bugs or vulnerabilities that could result in loss of funds.
- Regulatory risk: Cryptocurrency regulations vary by jurisdiction and may change. Tokens or Platform features may become restricted or prohibited in your jurisdiction.
- Liquidity risk: LP liquidity depends on the initial amount provided by the creator and subsequent trading activity. There may be limited liquidity, and you may not be able to sell tokens at a favorable price.
- Network risk: Arc Chain network congestion, outages, or changes could affect transactions and access to funds.
- Wallet security: If you lose access to your wallet or your private keys are compromised, your funds cannot be recovered by the Platform.
- No deposit insurance: Funds held in smart contracts or blockchain wallets are not protected by any government deposit insurance scheme.
11. Jurisdiction Restrictions
The Platform is not available to persons or entities located in, incorporated in, or residents of the following Restricted Jurisdictions:
- United States of America and its territories
- People's Republic of China (mainland)
- Democratic People's Republic of Korea (North Korea)
- Islamic Republic of Iran
- Cuba
- Syria
- Crimea, Donetsk, and Luhansk regions
- Myanmar (Burma)
- Venezuela
- Belarus
- Zimbabwe
- Any other jurisdiction where cryptocurrency trading is prohibited by law
If you access the Platform from a Restricted Jurisdiction, you do so at your own risk and are solely responsible for compliance with local laws. We reserve the right to restrict access from any jurisdiction at any time.
12. Modification of Terms
We reserve the right to modify these Terms at any time. Changes take effect when posted on this page. The "Last updated" date at the top of this page reflects the most recent revision. Material changes will be communicated through the Platform interface where feasible.
Your continued use of the Platform after any modifications constitutes acceptance of the revised Terms. If you disagree with changes, you must stop using the Platform.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to conflict of law principles. Any legal proceedings shall be conducted in English.
14. Dispute Resolution
Any dispute arising from or relating to these Terms or the Platform shall first be attempted to be resolved through good-faith negotiation between the parties for a period of 30 days. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the Centro de Arbitragem Comercial (Portuguese Commercial Arbitration Centre). The arbitration shall be conducted in English and take place in Lisbon, Portugal.
You agree to waive any right to participate in class action lawsuits or class-wide arbitration against the Platform.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

PRIVACY POLICY
1. Introduction
This Privacy Policy explains how Arcade ("the Platform", "we", "us") collects, uses, stores, and protects information when you use our services. We are committed to protecting your privacy and processing personal data in compliance with applicable data protection regulations, including the EU General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA).
2. Data We Collect
We collect the following categories of information:
2.1 Blockchain Data
- Wallet addresses (public keys) used to connect to the Platform.
- Transaction data including trades, token deployments, and smart contract interactions.
- Token ownership and balances as recorded on Arc Chain.
Note: blockchain data is public by nature. Wallet addresses and transactions are visible to anyone on the Arc Chain network.
2.2 Profile Information
- Display names or usernames you choose to set.
- Profile images or avatars you upload.
- Token metadata you provide (names, symbols, descriptions, images).
2.3 Technical Data
- IP address and approximate geographic location.
- Browser type, version, and operating system.
- Device type and screen resolution.
- Pages visited, time spent, and navigation patterns.
- Referral source (how you found the Platform).
3. How We Use Your Data
We use collected data for the following purposes:
- Platform operation: displaying token information, processing trades, and rendering the user interface.
- Security: detecting and preventing fraud, abuse, and unauthorized access.
- Analytics: understanding usage patterns to improve the Platform.
- Compliance: meeting legal obligations and responding to lawful requests from authorities.
- Communication: sending service-related notifications if you opt in to receive them.
4. Data Storage and Security
We store data on secure servers with industry-standard protections including encryption at rest and in transit, access controls, and regular security reviews. Uploaded images and metadata are stored on our servers and may be cached by CDN providers.
Despite our security measures, no system is completely secure. We cannot guarantee absolute security of your data. You are responsible for maintaining the security of your wallet and any credentials used to access the Platform.
5. Third-Party Services
The Platform integrates with the following third-party services:
- Arc Chain RPC: blockchain data is transmitted through Arc Chain's RPC endpoints to process transactions and read on-chain state.
- WalletConnect: if you connect using WalletConnect, your connection data is processed by WalletConnect's relay servers according to their privacy policy.
- Analytics providers: we may use privacy-focused analytics tools to understand aggregate usage patterns.
We do not sell your personal data to third parties. We do not share personal data with third parties for their marketing purposes.
6. Cookies and Tracking
The Platform may use:
- Essential cookies: required for basic functionality such as wallet connection state and user preferences. These cannot be disabled.
- Analytics cookies: used to collect aggregate usage statistics. You can opt out of analytics cookies through your browser settings.
We do not use advertising cookies or tracking pixels. We do not participate in cross-site tracking or retargeting networks.
7. Your Rights
7.1 GDPR Rights (EU/EEA Users)
If you are located in the EU or EEA, you have the following rights under GDPR:
- Right of access: request a copy of the personal data we hold about you.
- Right to rectification: request correction of inaccurate personal data.
- Right to erasure: request deletion of your personal data, subject to legal retention requirements.
- Right to restrict processing: request that we limit how we use your data.
- Right to data portability: receive your data in a structured, machine-readable format.
- Right to object: object to processing of your data for specific purposes.
Note: blockchain data (wallet addresses, transaction history) is immutable and cannot be modified or deleted from the Arc Chain network. Our ability to fulfill erasure requests is limited to data stored on our servers, not on-chain data.
7.2 CCPA Rights (California Residents)
If you are a California resident, you have the right to:
- Know what personal information we collect and how it is used.
- Request deletion of your personal information.
- Opt out of the sale of personal information (we do not sell personal information).
- Non-discrimination for exercising your privacy rights.
8. Data Retention
We retain personal data for as long as necessary to provide the Platform's services and fulfill the purposes described in this policy. Specific retention periods:
- Account/profile data: retained while your wallet has interacted with the Platform, and for up to 2 years after last activity.
- Transaction records: retained for a minimum of 5 years for compliance purposes.
- Technical/analytics data: retained for up to 12 months, then anonymized or deleted.
- Uploaded images and media: retained while the associated token exists on the Platform.
Blockchain data is retained permanently on-chain and is outside our control.
9. International Data Transfers
Your data may be transferred to and processed in countries other than your country of residence. We ensure that appropriate safeguards are in place for international transfers, including Standard Contractual Clauses (SCCs) approved by the European Commission where applicable.
10. Children's Privacy
The Platform is not intended for users under 18 years of age. We do not knowingly collect personal data from children under 18. If we become aware that we have collected data from a child under 18, we will take steps to delete that information promptly.
11. Changes to This Policy
We may update this Privacy Policy from time to time. Changes take effect when posted on this page. The "Last updated" date at the top reflects the most recent revision. We encourage you to review this policy periodically.
